surveillance video program but making money off the program. >> good morning, thanks positive -- thanks for joining us. tragedy could affect your commute. >> correct. in oakland, we have a fatal accident. someone was running across the freeway and a car hit them. this is westbound 580 with a sig-alert in effect. the left lanes are blocked until we get further word but 39 miles per hour is the top speed. avoid westbound 580. take 880 instead. we thought this would do something for the bay bridge toll plaza and it could lighten the traffic. that is not the case. this is coming away from emeryville with the metering lights on at 10:00 with tons of traffic moving from emeryville to san francisco.

matt? >> the child and the father will return to santa clara county. one is a joyful row union at the sunnyvale home. the other will involve the district attorney's office. the 22-year-old father was captured in mexico yesterday afternoon at a checkpoint with his two week old son. the father abducted the child open tuesday afternoon and sent the girlfriend a text threatening to harm himself and the baby if she called police. the cell phone of the suspect was picked up but he got past border control and he was found in lukeville, arizona. based on the interview they called the border patrol at lukeville and gave the name, the border patrol ran the name in the computer and discovered a warrant for his arrest. the two week old baby is scared for by authorities until he can be returned. he is held by arizona

state lawmakers called an investigative hearing in san francisco following the deaths of two bart workers during the strike last month. to were working on the tracks when they were hit and killed by a train. we stay with abc7 news next half hour when katie marzullo will tell us the big tinge that the state lawmakers are expected to demand of bart at the hearing. >> officials say it will take a month longer than expected to complete the permanent fix for the giant steel bolts that snapped on the new eastern span. our media participate, the "contra costa times" reports the $23 million custom saddles are operational by january 8. officials hoped to be done by december 10th but they say fabrication was complex and took locker than expected. the span that opened labor day will remain if place until the saddles are installed. >> city officials in san

covering walnut creek, burlingame, campbell and all bay area this is abc7 news. >> the early morning view of san francisco from our camera shows high clouds with more on the forecast and leyla gulen is following a fatal accident in the east bay. this morning, another sign of how broad intelligence-gathering by the u.s. government is. the c.i.a. now is paying at&t more than $10 million a year for access to phone records of possibly terrorism suspects. "new york times" reports that the deal between the c.i.a. and at&t is voluntary and not under a court order. under the agreement, the c.i.a. gives at&t the phone numbers of terrorism suspects. at&t searches their database and

towns over records of calls. the c.i.a. is not commenting on the program. >> twitter goes public in 15 minutes at 6:30. another company from twitter co-founder dorsey is also on the verge of hitting wall street. we mobile credit card payment company could launch an i.p.o. next year. dorsey owns 26 percent of square which is worth over $800 million if he did not get enough from twit other. the card readers are widely used in starbuck, takes and food trucks. >> a high school is blurred to ditch a mascot of 82 years. we the high school mascot "the arab," is under fire. the arab anti-discrimination committee is urging the school to drop the arab name because it reinforces negative stereotypes of arabs and arab americans. alumni disagree believing the

we have traffic loosening us. you do not need to use the alternate if you do not want to take 880. the life is slow down in the southbound direction with this accident blocking one lane at coliseum way and to the south, the backup headed over to hayward is another vehicle accident southbound 880 at washington blocking a lane causing pressure northbound 238. into tracy the crash is cleared and westbound 580 causing heavy congestion. >> happening today, bart officials will face tough questions from state lawmakers wanting to prevent another tragedy on the rails. this follows the death of two workers who were hit and killed by a train dug -- during the strike. katie marzullo has more. >> i have the testimony that two top bart officials are going to

give state lawmakers in a few hours. one is the chief safety officer and he will tell lawmakers bart has an extensive safety program and it has been approved by state and federal authorities. also, the california public utilities commission which oversees bart has performed we 30 inspections so far this year. the assistant general manager will testify about safety approval and address changes made to the policy after a worker was killed in 2008. simple approval makes workers responsible for their own safety on the tracks. that is what christopher shepard and larry daniels were doing while inspecting the tracks weapon they were killed october 19. james strict land had simple approval when killed in 2008. osha cited bart for the practice but bart management fought to keep it. san francisco assemblyman says
